Terms of Service
This is an English translation. If there is any discrepancy, the Portuguese version prevails.
These terms govern your use of the Audissey app and related services (the “service”). We have written them in plain language, but they are an agreement between you and us — please read them carefully.
Acceptance
Audissey is provided by Tiago Costa, an individual based in Portugal (“we” or “us”). By creating an account or using Audissey, you accept these terms. If you do not agree, do not use the service.
How we handle your personal data is explained in the Privacy Policy.
The service
- Audissey is free, shows no ads of its own and has no in-app purchases. Radio streams and podcasts may include their owners' own ads.
- Audissey brings together in one place radio streams, podcast feeds and programme information made publicly available by third parties, and helps you discover, organise and listen to them.
- Audissey does not own that content and does not control it. Audio and images are fetched directly from the stations' and publishers' servers.
- We do not guarantee that any stream, podcast or programme guide will always be available, complete or accurate. Stations and publishers can change or remove their content at any time, and part of the programme information is collected and organised automatically, so it may contain errors.
Your account
- You must be at least 13 years old to create an account. If you are under 18, we recommend reading these terms with your parents or legal guardian.
- Give us accurate information and keep it up to date.
- Keep your password and access to your account email safe (the email can be used to sign in with a magic link). If you suspect unauthorised access, let us know.
- Your account is personal: it is for one person only and may not be transferred, sold or shared.
Acceptable use
You may use Audissey for personal, non-commercial purposes. You may not:
- extract data from the service by automated means or in bulk (scraping), or use bots or scripts to access the service;
- reverse engineer, decompile or disassemble the app, except to the extent the law expressly allows;
- circumvent limits, security measures or technical protections, or try to access other people's accounts or data;
- overload, disrupt or abuse the service or the infrastructure behind it;
- use Audissey for illegal purposes or to infringe the rights of others;
- rebroadcast, record for distribution or make publicly available content you access through Audissey;
- impersonate anyone else or create accounts with false details.
If you use Audissey while driving, do so safely and in line with the law — your attention to the road always comes first.
Third-party content and copyright
The radio stations, podcasts, programmes, names, logos and images you find in Audissey belong to their respective owners. Audissey gives access to content those owners make publicly available; the audio is streamed from their servers. Episodes you download to listen offline stay only on your device, for personal use.
If you are a rights holder and believe any content or information in Audissey infringes your rights, or you would like your station or podcast to stop appearing, email alerts@audissey.io, identifying the content and the rights concerned. We review every request and act promptly.
Audissey's intellectual property
The Audissey name and logo, the app, its design, software and original texts belong to Tiago Costa or to their respective licensors. As long as you comply with these terms, we give you a personal, non-exclusive, non-transferable and revocable licence to use the app for personal, non-commercial purposes. Open-source components included in the app are subject to their own licences.
What you share
- Shared programmings: when you share a programming by link, anyone who has the link can see it for 7 days, including your profile name (or “Ouvinte” — “Listener” — if you have none). Only share the link with people you choose.
- Feedback: if you send us suggestions, comments or screenshots, we may use them to improve Audissey, with no obligation to compensate you. Do not include other people's personal data or sensitive information in screenshots.
Third-party services
Audissey works together with services from other companies, which have their own terms and privacy policies:
- signing in with Google, Apple or Facebook;
- the YouTube player built into the app and links to Spotify;
- the stores and platforms through which you get the app;
- Android Auto, Apple CarPlay, Wear OS, Siri, Google Assistant and the operating system's speech recognition and location services.
When you use those services, their terms also apply. We are not responsible for how those services work or for their practices.
Changes and availability of the service
Audissey is evolving. We may add, change or remove features. The service may be temporarily unavailable due to maintenance, technical failures or reasons beyond our control, and we do not guarantee it will always work without interruption. If we decide to end the service, we will give you reasonable notice whenever possible.
Suspension and termination
- You can stop using Audissey at any time and ask for your account to be deleted — see how on the Delete account page.
- We may suspend or close an account in case of serious or repeated breach of these terms, abuse of the service, a security risk or where the law requires it. Where appropriate, we will let you know and explain why. If you disagree, you can challenge the decision by email.
- When an account is closed, the data is handled as described in the Privacy Policy.
Warranties and liability
Audissey is a free service, provided “as is” and “as available”. To the extent permitted by law, we give no warranties about the availability, accuracy or quality of third-party content, and we are not responsible for that content or for third-party services.
To the extent permitted by law, we are not liable for indirect damage resulting from using or being unable to use the service.
Nothing in these terms excludes or limits our liability for wilful misconduct (dolo) or gross negligence (culpa grave), for harm to life, physical integrity or health, or the rights the law gives you as a consumer that cannot be waived by contract, including rights relating to the conformity of digital content and services.
Governing law and disputes
These terms are governed by Portuguese law. If you are a consumer living in another European Union country, you keep the protection of the mandatory rules of that country's law.
If you have a problem, please talk to us first at alerts@audissey.io — we will try to resolve it. If we cannot reach an agreement, disputes will be settled by the courts with jurisdiction under the law.
As a consumer, you can also turn to a consumer alternative dispute resolution entity. The list of these entities is available on the Portuguese Consumer Portal at www.consumidor.gov.pt.
Changes to these terms
We may update these terms, for example when Audissey or the law changes. The “Last updated” date shows the version in force. If the changes are significant, we will let you know in the app or by email reasonably in advance of them taking effect. If you do not agree with the new terms, you can stop using Audissey and delete your account; if you keep using it after they take effect, we will consider that you accept them.
General provisions
If any part of these terms is found to be invalid, the rest continues to apply. If we do not enforce a rule at a given moment, that does not mean we waive it.
